Subject: Justice's Dutton/Anderson Affair.


The prosecution has successfully brought an unexpected weapon into the legal battle to gain access to documents relating to the Dutton/Anderson affair. The defense recently filed papers asking for a jury instruction on jury selection regarding the alleged events of August 29, 1999. I asked Gwyn about this matter and learned (via Ben) that it may be mentioned in opening statements if it appears relevant enough by lawyers of both sides.


I tried to file a motion here to file comments as evidence on behalf of the prosecution concerning these new developments. However, as some of you know, when we first argued our issues in trial over the matters raised in this memo, we never disclosed the filing of the motions or other evidence submitted by this court. In any event, we have not yet conducted any depositions to proceed with discovery production but are very much looking forward to doing so very soon. Additionally, due to constraints from prosecutors who can only agree in portions, my lawyer may make it clear to Gwyn Farrell whether he wants me personally to appear on all "relevant" documents during the discovery process, including in front of this court.
